A state appeals court has reinstated a wrongful death lawsuit filed by an NIU fraternity pledge who died in 2012 from alcohol poisoning.
The appellate court overturned a Cook County judge and revived the suit by the family of David Bogenberger against the NIU chapter of Pi Kappa Alpha and its members. The suit claims frat members were responsible for the 19-year-old's death because pledges were required to participate in excessive drinking to win membership.
Five former frat members were sentenced to community service and fines in a criminal hazing case arising from Bogenberger's death.
