No charges will be filed following the death of a Rochelle man which was called a homicide by DeKalb County officials earlier this year.
On March 26th, local police were contacted by the DeKalb County Coroner's office in reference to a death investigation. 74-year old David Rosek, a former patient at Rochelle Gardens at 1021 North Caron Road, had passed away and an autopsy was scheduled to determine the cause and manner of death.
Rosek was involved in an altercation with another man on January 7th at the facility. He suffered a subdural hematoma.
Police investigated the incident and learned that the other individual involved in the fight was moved to another facility.
The autopsy was completed on April 21st. The cause of death for Rosek was pneumonia due to a consequence of subdural hematoma from the assault. The manner of death was listed as a homicide.
Ogle County State's Attorney Mike Rock said that no charges will be filed in the case due to the lack of evidence and people who saw the altercation.
